IB 705.11 Non-Competitive Contracts

This interpretation provides for non-competitive procurement in observance of strict regulatory criteria and in conformance with fairness, transparency and accountability.

IB 705.01, IB 705.02 and IB 705.03 provide additional guidance on the sole-source procurement process (i.e. flow charts). Non-competitive procurement is further described in the GNWT Procurement Procedures Manual.

INTERPRETATION

Departments and Agencies wishing to undertake a non-competitive procurement process (i.e. sole-source or negotiated contract) should consult with the Procurement Shared Services Division (PSS) in the Department  of Finance to identify the most appropriate means by which to proceed. In particular, there is a requirement for PSS to be involved for contracts:

  • $25,000 or greater;
  • requiring a formal Request for Tender (RFT) or Request for Proposal (RFP); or,
  • for a Northern Manufactured Product.

All procurement transactions described above must also be properly justified, appropriately authorized, and recorded in the corporate financial management system (e.g. SAM).

The Deputy Head (or delegate) of the requesting organization, as the primary contract authority, should approve or reject the sole-source recommendation.

All non-competitive procurement activities must be supported by appropriate documentation as they are subject to audit.
